TSL Patcher dialog.tlk error

When trying to install the HK Factory reconstructed mod I get this error at the beginning of the patcher install:

• Installation started 11/22/2008 12:13:08 PM...
• Appending strings to TLK file "C:\Program Files\LucasArts\SWKotOR2\dialog.tlk"
• Saving unaltered backup copy of dialog.tlk file in C:\Users\*****\AppData\Local\Temp\Rar$EX48.887\HK-Factory Reconstructed\English Version\backup\
• Error: Unhandled exception: Cannot create file "C:\Program Files\LucasArts\SWKotOR2\dialog.tlk". The process cannot access the file because it is being used by another process (0)

Anyideas why I get this? also my dialog.tlk is not read protected.
